1. Scope / Provider

(1) These Terms & Conditions apply to the use of the website biturai.com including all subdomains (e.g. news.biturai.com) as well as linked presences (including YouTube, Instagram, X, Newsletter), the Telegram Community (https://t.me/biturai_chat), and the Community Platform skool.com (Biturai Community) operated by Biturai L.L.C‑FZ.

(2) For the use of third-party platforms such as Telegram, their respective terms of use and privacy policies additionally apply.

3. Services / Dashboard Disclaimer

(1) Education & Community: Biturai provides educational and community services (online courses, live calls, discussion rooms) via third-party platforms (e.g. Skool).

(2) Live Dashboard: The dashboard provided on the website visualizes trading data for informational purposes ("Best Effort").

• We assume no warranty for accuracy, completeness, or real-time availability of the data.
• Data may be delayed or contain errors.
• The dashboard does not constitute a basis for financial transactions.

(3) No VASP Status: Biturai is not a Virtual Asset Service Provider (VASP) licensed by VARA. Our content is not specifically directed at residents of the UAE where this is prohibited by regulation.

3a. Dojo Chat (Real-Time Chat)

(1) Biturai provides logged-in members with a real-time chat system ("Dojo Chat") for communication.

(2) Code of Conduct: Community guidelines apply in the chat. Specifically prohibited are: spam, insults, illegal content, advertising for third-party providers without authorization.

(3) Moderation: Biturai reserves the right to delete messages and to suspend users who violate the rules (temporarily or permanently).

(4) Rank-Based Access: Certain chat rooms are accessible only to members of higher ranks (e.g. Samurai, Sensei, Shogun). Rank is determined by activity and performance on the platform.

3b. AI Assistant ("Biturai")

(1) Biturai offers an AI-powered assistant ("Biturai") to support trading questions and market analyses.

(2) No Financial Advice: AI responses do not constitute financial advice. All information is for educational purposes only.

(3) Accuracy: The AI may provide incorrect or incomplete information. No warranty for accuracy is assumed.

(4) Data Privacy in Community Areas: In public chat areas, the AI will never disclose personal user data (win rate, trades, performance) — not even upon request by third parties. In your private area, the AI can access your own data upon request.

(5) Learning Function: The AI may learn from conversations to improve the service. By using the service, you agree to this processing.

3c. Trading Wiki & Crypto News (AI Content)

(1) AI Generation: The "Biturai Wiki" and "Crypto News" sections are created automatically with the aid of Artificial Intelligence (including Google Gemini) and external data sources.

(2) No Warranty: While we strive for high quality, AI-generated content may contain errors ("hallucinations"), outdated data, or inaccuracies. Content is not necessarily manually verified before publication.

(3) Images: The images used are often AI-generated artistic representations and do not depict real persons, places, or physical objects.

(4) Legal Notice: Articles are for informational (educational) purposes only and do not replace professional advice. Biturai accepts no liability for decisions made based on this automated content.

3d. Trading Journal & Exchange API Integration

(1) Biturai offers a Trading Journal that connects to cryptocurrency exchanges via API to track and analyze your trading activity.

(2) Read-Only Access: We exclusively use read-only API keys. Biturai never has the ability to execute trades, withdraw funds, or modify your exchange account in any way.

(3) Responsibility: You are solely responsible for the security of your API keys and exchange account. Biturai is not liable for any unauthorized access to your exchange account.

(4) Data Use: Trading data is used for your personal journal, performance analytics, leaderboard rankings, and Dojo rank calculation. Aggregated and anonymized data may be displayed publicly on leaderboards.

(5) No Warranty: We assume no warranty for the accuracy, completeness, or timeliness of data retrieved from exchange APIs. Data may be delayed, incomplete, or contain errors.

4. Affiliate Disclosure

(1) On the website and in the community, so-called affiliate links to external providers (e.g. cryptocurrency exchanges) may be provided.

(2) Transparency: If users register or trade via these links, Biturai may receive a commission from the provider. These revenues help to finance the operation of the platform, the dashboard, and free content.

(3) No Extra Costs: The use of these links does not create any disadvantages or additional costs for the user (often even advantages such as fee discounts or cashback, as stated on the website).

(4) Biturai is not a contracting party of these third-party providers (exchanges) and assumes no liability for their services, fee structures, or security.

5. Contractual Relationships / Payments (Skool.com)

(1) The purchase of paid content or memberships (e.g. Masterclass, Community Access) is handled exclusively via the platform Skool.com.

(2) Merchant of Record: Skool is the contracting party for payment processing. Payments, invoicing, tax handling, and withdrawal/refund requests (refunds) are subject solely to the terms and conditions of Skool.com.

(3) Biturai does not store full payment data (credit card information, etc.).

6. Memberships / Terms

(1) Free memberships are permanently free of charge.

(2) Subscriptions (e.g. monthly/annual) are to be managed via Skool.com. Cancellations must be made in a timely manner via the settings on Skool.com (effective at the end of the respective term).

7. Intellectual Property

All materials (videos, texts, graphics, software code, dashboard designs) on biturai.com and in the community are protected by copyright. Any reproduction, distribution, or public reproduction — in particular, sharing paid content with third parties — is prohibited without written permission.

8. Limitation of Liability

(1) Biturai is liable without limitation in cases of intent or gross negligence, as well as for damages resulting from injury to life, body, or health.

(2) In cases of slight negligence, Biturai is only liable for breach of material contractual obligations (cardinal obligations), limited to the typical, foreseeable damage.

(3) Exclusion for Trading Losses: Liability for financial losses, lost profits, or damages resulting from the user's trading decisions, the use of copy-trading, or the use of platform data is explicitly excluded. The user acts 100% at their own responsibility.

9. Links to Third Parties

Our website contains links to external websites of third parties, on whose contents we have no influence. Therefore, we cannot assume any liability for these external contents. The respective provider or operator of the pages is always responsible for the content of the linked pages.

10. Governing Law / Jurisdiction

(1) The laws of the Emirate of Dubai (outside DIFC) and the federal laws of the United Arab Emirates (UAE) apply.

(2) The place of jurisdiction is Dubai, UAE.

(3) Consumer Protection: Mandatory consumer protection provisions of the state in which the user has their habitual residence (e.g. Germany/EU) remain unaffected by this choice of law.
